Welkom bij Consultant Workspace (hierna “de Service”), een platform beheerd door Zodiac Consultants Group B.V. (hierna “ZCG”, “wij”, “ons” of “onze”). De Service is beschikbaar via de webomgeving Consultant Workspace en de mobiele applicaties ConsultantWS voor iOS en Android.

Wij hechten grote waarde aan uw privacy en de bescherming van uw persoonsgegevens. Deze Privacy Policy legt uit welke persoonsgegevens wij verzamelen, hoe wij deze gebruiken, met wie wij deze delen en welke rechten u heeft met betrekking tot uw gegevens.

Door gebruik te maken van onze Service, gaat u akkoord met de praktijken beschreven in deze Privacy Policy.

3. Welke gegevens verzamelen wij?

3.1 Gegevens die u ons verstrekt

Voor Consulenten:

  • Accountgegevens: Voor- en achternaam, e-mailadres, telefoonnummer, wachtwoord
  • Zakelijke informatie: KvK-nummer, BTW-identificatienummer, bankrekeningnummer (IBAN), bedrijfsnaam
  • Profielinformatie: Profielfoto, beschrijving van diensten, tarieven, specialisaties, werkervaring
  • Identiteitsverificatie: Kopie identiteitsbewijs (indien vereist voor verificatie)
  • Voorkeuren: Beschikbaarheid, diensten die u aanbiedt, communicatievoorkeuren

Voor Klanten:

  • Accountgegevens: Voor- en achternaam, e-mailadres, telefoonnummer, wachtwoord
  • Betalingsgegevens: Creditcard- of betaalkaartgegevens, factureringsadres
  • Communicatie: Inhoud van gesprekken, chatberichten en andere communicatie via de Service

3.2 Gegevens die wij automatisch verzamelen

  • Gebruiksgegevens: IP-adres, browsertype, apparaattype, besturingssysteem, pagina’s die u bezoekt, tijdstip en duur van uw bezoek
  • Locatiegegevens: Geschatte locatie op basis van IP-adres (niet exact)
  • Cookies en trackingdata: Zie sectie 8 voor meer informatie over cookies
  • App-gebruiksgegevens: Interacties binnen de ConsultantWS mobiele apps

3.3 Transactiegegevens

  • Gegevens over consulten: datum, tijd, duur, type dienst, tarieven
  • Betalingsgeschiedenis en facturatie
  • Opname- en uitbetalingsverzoeken (voor consulenten)
  • Statistieken over inkomsten en gebruik van de Service

4. Waarvoor gebruiken wij uw gegevens?

Wij verwerken uw persoonsgegevens voor de volgende doeleinden:

4.1 Uitvoering van de overeenkomst

  • Het faciliteren van accountregistratie en -beheer
  • Het mogelijk maken van communicatie tussen consulenten en klanten
  • Het verwerken van betalingen en uitbetalingen
  • Het genereren van facturen en financiële overzichten
  • Het bieden van klantenservice en ondersteuning

4.2 Wettelijke verplichtingen

  • Het voldoen aan fiscale en boekhoudkundige verplichtingen
  • Het naleven van wet- en regelgeving (inclusief AVG)
  • Het voorkomen van fraude en misbruik

4.3 Legitieme belangen

  • Het verbeteren en optimaliseren van de Service
  • Het analyseren van gebruikspatronen en statistieken
  • Het verzenden van serviceberichten en updates
  • Het waarborgen van de veiligheid en integriteit van de Service
  • Het oplossen van technische problemen

4.4 Met uw toestemming

  • Het verzenden van marketing- en promotiecommunicatie (u kunt zich te allen tijde afmelden)
  • Het plaatsen van niet-essentiële cookies
  • Het delen van uw gegevens met derde partijen voor specifieke doeleinden

5. Rechtsgrondslag voor gegevensverwerking

Wij verwerken uw persoonsgegevens op basis van de volgende rechtsgronden conform de AVG:

  • Uitvoering van een overeenkomst: Voor het leveren van de Service die u heeft aangevraagd
  • Wettelijke verplichting: Voor naleving van fiscale en juridische verplichtingen
  • Gerechtvaardigd belang: Voor verbetering van de Service, beveiliging en fraudepreventie
  • Toestemming: Voor marketing en niet-essentiële cookies (u kunt deze toestemming te allen tijde intrekken)

6. Met wie delen wij uw gegevens?

6.1 Binnen de Service

  • Consulenten en klanten: Bepaalde profielinformatie wordt gedeeld om consulten mogelijk te maken
  • Partnerplatforms: Uw profiel kan worden weergegeven op ZCG-partnerplatforms zoals TopConsulenten, Wundra en Videnso

6.2 Dienstverleners

Wij werken samen met betrouwbare derde partijen die ons helpen de Service te leveren:

  • Betalingsproviders: Voor het verwerken van betalingen en uitbetalingen
  • Hostingproviders: Voor het opslaan van gegevens en hosten van de Service
  • Communicatiediensten: Voor e-mail, SMS en push-notificaties
  • Analysetools: Voor het analyseren van gebruiksstatistieken (geanonimiseerd waar mogelijk)
  • Klantenservicetools: Voor het bieden van ondersteuning

Deze partijen verwerken gegevens uitsluitend in opdracht van ons en volgens onze instructies.

6.3 Wettelijke verplichtingen

Wij kunnen uw gegevens delen wanneer dit wettelijk verplicht is, bijvoorbeeld:

  • Bij gerechtelijke bevelen of verzoeken van autoriteiten
  • Voor het beschermen van onze rechten, privacy, veiligheid of eigendom
  • In geval van fraude of andere illegale activiteiten

6.4 Bedrijfsoverdracht

Bij een fusie, overname of verkoop van activa kunnen uw gegevens worden overgedragen aan de nieuwe eigenaar.

Uw gegevens worden primair verwerkt binnen de Europese Economische Ruimte (EER). Als wij gegevens overdragen naar landen buiten de EER, zorgen wij voor passende waarborgen zoals:

Ondanks deze maatregelen kunnen wij geen absolute veiligheid garanderen. U bent zelf verantwoordelijk voor het vertrouwelijk houden van uw inloggegevens.

10. Bewaartermijnen

Wij bewaren uw persoonsgegevens niet langer dan noodzakelijk voor de doeleinden waarvoor ze zijn verzameld:

  • Accountgegevens: Zolang uw account actief is
  • Transactiegegevens: 7 jaar (conform fiscale wetgeving)
  • Communicatiegegevens: 1 jaar na laatste contact
  • Marketinggegevens: Tot u zich afmeldt of gedurende 3 jaar na laatste interactie
  • Analytische gegevens: Geanonimiseerd na 2 jaar

Na verloop van de bewaartermijn worden uw gegevens veilig verwijderd of geanonimiseerd.

11. Uw rechten

Op grond van de AVG heeft u de volgende rechten met betrekking tot uw persoonsgegevens:

11.1 Recht op inzage

U heeft het recht om te weten welke gegevens wij van u verwerken en een kopie hiervan op te vragen.

11.2 Recht op rectificatie

U kunt onjuiste of onvolledige gegevens laten corrigeren.

11.3 Recht op verwijdering (‘recht op vergetelheid’)

U kunt verzoeken om verwijdering van uw gegevens, tenzij wij een wettelijke verplichting hebben om deze te bewaren.

11.4 Recht op beperking

U kunt de verwerking van uw gegevens laten beperken in bepaalde situaties.

11.5 Recht op gegevensoverdraagbaarheid

U kunt uw gegevens in een gestructureerd en gangbaar formaat opvragen om over te dragen naar een andere dienstverlener.

U kunt bezwaar maken tegen verwerking van uw gegevens op basis van gerechtvaardigd belang of voor direct marketing.

11.7 Recht om toestemming in te trekken

Als wij uw gegevens verwerken op basis van toestemming, kunt u deze te allen tijde intrekken.

11.9 Klacht indienen

Als u van mening bent dat wij uw privacy niet goed beschermen, kunt u een klacht indienen bij de Autoriteit Persoonsgegevens: www.autoriteitpersoonsgegevens.nl.

12. Gegevens van minderjarigen

Onze Service is niet bedoeld voor personen jonger dan 18 jaar. Wij verzamelen niet bewust gegevens van minderjarigen. Als u vermoedt dat wij onbedoeld gegevens van een minderjarige hebben verzameld, neem dan contact met ons op.

For Consultants:

  • Account information: First and last name, email address, phone number, password
  • Business information: Chamber of Commerce number, VAT identification number, bank account number (IBAN), company name and extracts
  • Profile information: Profile photo, description of services, rates, specializations, work experience
  • Identity verification: Copy of identity document (if required for verification)
  • Preferences: Availability, services you offer, communication preferences

3.2 Data We Collect Automatically

  • Usage data: IP address, browser type, device type, operating system, pages you visit, time and duration of your visit
  • Location data: Estimated location based on IP address (not exact)
  • Cookies and tracking data: See section 8 for more information about cookies
  • App usage data: Interactions within the ConsultantWS mobile apps

3.3 Transaction Data

  • Consultation data: date, time, duration, type of service, rates
  • Payment history and invoicing
  • Withdrawal and payout requests
  • Statistics on revenue and use of the Service
